The regulation develops the mandate <strong>set out in the \u201cCrea y Crece\u201d Law and lays the foundations of the new Spanish electronic invoicing system<\/strong>.<\/p>\n<p>The Royal Decree <strong>specifies three key obligations<\/strong>: the issuance, transmission, and receipt of electronic invoices in the B2B environment; the obligation for the recipient to report the status of invoices; and the obligation, also on the recipient\u2019s side, to report the status of payments.<\/p>\n<h2>From legal approval to practical implementation<\/h2>\n<p>The Royal Decree has already been approved and the <strong>draft Ministerial Order has been published<\/strong>. The latter establishes the key dates for the mandatory implementation of electronic invoicing (detailed in the following sections) and includes the <strong>general technical parameters as well as certain specifications<\/strong> of the public electronic invoicing solution.<\/p>\n<p>In a subsequent phase, from draft to publication of the Ministerial Order in the Official State Gazette (BOE), this Order will mark the final step and will be responsible for:<\/p>\n<ul>\n<li>Defining the <strong>technical parameters<\/strong> and specifications of the public electronic invoicing solution.<\/li>\n<li>Detailing the <strong>interfaces, services, authentication mechanisms, and operational rules<\/strong> of the system.<\/li>\n<li>Establishing <strong>any other technical aspects<\/strong> not defined in the Royal Decree itself.<\/li>\n<\/ul>\n<h2>Mandatory electronic invoicing: who it applies to<\/h2>\n<p>Mandatory electronic invoicing applies <strong>exclusively to B2B transactions<\/strong> between companies and professionals that are required to issue invoices under Spanish regulations when:<\/p>\n<ul>\n<li>The recipient is <strong>established in Spain<\/strong>.<\/li>\n<li>Or the recipient has a <strong>permanent establishment, domicile, or habitual residence in Spain<\/strong> and the transaction is linked to that establishment.<\/li>\n<\/ul>\n<p>The regulation does not apply to simplified invoices; regulated electricity and gas markets; or IATA invoicing (BSP, CASS, and SIS\u2011ICH).<\/p>\n<h2>Electronic B2B invoicing implementation timetable in Spain<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-13726 \" src=\"https:\/\/www.voxelgroup.net\/blog\/wp-content\/uploads\/2026\/04\/EN_Spain-Calendar-578x1024.png\" alt=\"Spain\u2019s electronic invoicing schedule for 2026\" width=\"379\" height=\"671\" srcset=\"https:\/\/www.voxelgroup.net\/blog\/wp-content\/uploads\/2026\/04\/EN_Spain-Calendar-578x1024.png 578w, https:\/\/www.voxelgroup.net\/blog\/wp-content\/uploads\/2026\/04\/EN_Spain-Calendar-169x300.png 169w, https:\/\/www.voxelgroup.net\/blog\/wp-content\/uploads\/2026\/04\/EN_Spain-Calendar-768x1360.png 768w, https:\/\/www.voxelgroup.net\/blog\/wp-content\/uploads\/2026\/04\/EN_Spain-Calendar.png 791w\" sizes=\"auto, (max-width: 379px) 100vw, 379px\" \/><\/p>\n<p>The implementation schedule <strong>will enter into force on October 1, 2026<\/strong>. In addition to electronic invoicing, it includes obligations to report the status of invoices and payments. For companies, this is structured as follows:<\/p>\n<h3>October 1, 2027 \u2013 Companies with annual turnover &gt; \u20ac8M<\/h3>\n<ul>\n<li>Electronic invoicing, invoice status reporting, and payment status reporting.<\/li>\n<li>During the first year of mandatory electronic invoicing, the e\u2011invoice must be accompanied by a PDF, as this is considered a transition period.<\/li>\n<\/ul>\n<h3>October 1, 2028 \u2013 Companies with annual turnover &lt; \u20ac8M<\/h3>\n<ul>\n<li>Electronic invoicing.<\/li>\n<li>Invoice status and payment status reporting.<\/li>\n<li>For individuals (mainly self\u2011employed professionals), these two reporting obligations will become mandatory as of October 1, 2029.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2>Other information of interest<\/h2>\n<ul>\n<li>B2B invoices must be issued <strong>exclusively in a structured electronic format<\/strong>. Accepted formats include UBL, CII, Facturae, and EDIFACT.<\/li>\n<li>The mandatory public repository will only accept the UBL format and must contain a faithful copy of each invoice.<\/li>\n<li>The invoice recipient must <strong>always report the effective payment of the invoice<\/strong>, <strong>including the actual payment date<\/strong>. This information must be communicated directly to the public electronic invoicing solution. The issuer may report the payment voluntarily, but the obligation lies with the recipient.<\/li>\n<li>The publication of Royal Decree 238\/2026 does not directly affect the <a href=\"https:\/\/www.voxelgroup.net\/blog\/en\/the-role-of-verifactu-in-electronic-invoicing\/\" target=\"_blank\" rel=\"noopener\">Verifactu<\/a> regime. The two regimes will coexist.<\/li>\n<li>Alignment with the European <a href=\"https:\/\/www.voxelgroup.net\/blog\/en\/vida-the-revolution-of-digital-taxation-in-europe\/\" target=\"_blank\" rel=\"noopener\">ViDA (VAT in the Digital Age)<\/a> regulation.<\/li>\n<\/ul>\n<h2>How the Spanish electronic invoicing system works<\/h2>\n<p>The issuance and receipt of invoices, as well as the notification of statuses, will be carried out through the Spanish electronic invoicing system. This system is composed of the <strong>public electronic invoicing solution, private electronic invoicing exchange platforms (PIFEs), and the company<\/strong>.<\/p>\n<p>The process will follow these steps:<\/p>\n<ul>\n<li>The issuing <strong>company\u2019s PIFE will send B2B invoices<\/strong>.<\/li>\n<li>The <strong>PIFE must also send a faithful copy of the invoice<\/strong>, in UBL format, to the public solution, which will act as a repository.<\/li>\n<li>The <strong>recipient must communicate acceptance or rejection of the invoice<\/strong> within a maximum of 4 calendar days from when that status occurs, <strong>and must also report payment<\/strong> within a maximum of 4 calendar days from the effective receipt of funds.
