{"id":12899,"date":"2025-03-25T09:31:33","date_gmt":"2025-03-25T08:31:33","guid":{"rendered":"https:\/\/www.voxelgroup.net\/blog\/?p=12899"},"modified":"2025-03-25T09:34:54","modified_gmt":"2025-03-25T08:34:54","slug":"updates-on-the-electronic-invoicing-law-in-spain","status":"publish","type":"post","link":"https:\/\/www.voxelgroup.net\/blog\/en\/updates-on-the-electronic-invoicing-law-in-spain\/","title":{"rendered":"Updates on the electronic invoicing law in Spain"},"content":{"rendered":"<span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Tiempo de lectura:<\/span> <span class=\"rt-time\"> 3<\/span> <span class=\"rt-label rt-postfix\">minutos<\/span><\/span><p>The Ministry of Economic Affairs and Digital Transformation<strong> has published the second draft of the royal decree regulating the use of mandatory electronic invoicing in business-to-business (B2B)<\/strong> transactions in Spain.<\/p>\n<p>This new text <strong>includes modifications regarding the implementation schedule<\/strong> and other aspects but <strong>maintains the two essential obligations<\/strong>: the issuance, transmission, and reception of <strong>B2B electronic invoices<\/strong>; and the obligation to inform <strong>the status of invoices by the recipient.<\/strong><\/p>\n<h2>Implementation schedule<\/h2>\n<p>One of the most relevant changes in this second draft is that the <strong>implementation schedule will depend on the publication of the Ministerial Technical Order (technical specifications)<\/strong> and not on the publication of the royal decree in the Official State Gazette (BOE). According to the current draft, the schedule is as follows:<\/p>\n<p><strong>Companies with turnover &gt; 8M \u20ac:<\/strong><\/p>\n<ul>\n<li>Electronic invoicing and invoice status reporting: 12 months from the publication of the Ministerial Technical Order.<\/li>\n<li>During the first year of mandatory electronic invoicing, the e-invoice must be accompanied by a PDF, unless the recipient waives it.<\/li>\n<\/ul>\n<p><strong>Companies with turnover &lt; 8M \u20ac:<\/strong><\/p>\n<ul>\n<li>Electronic invoicing: 24 months from the publication of the Ministerial Technical Order.<\/li>\n<li>Invoice status reporting: 36 months from the publication of the Ministerial Technical Order.<\/li>\n<\/ul>\n<h2>Other changes<\/h2>\n<ul>\n<li>The <strong>UBL format is included<\/strong> in the group of accepted e-invoice formats (Facturae, CII, EDIFACT). The possibility of expanding the list \u201cin consideration of the extent of its use in a particular economic sector or technological innovation in this field\u201d is maintained.<\/li>\n<li>The mandatory public repository will only accept the UBL format and must<strong> be a faithful copy of each invoice.<\/strong><\/li>\n<li>The obligation extends to all B2B invoices, including voluntary ones.<\/li>\n<li>Sectoral exclusions: electricity market, gas, and IATA invoicing (CASS, BSP, SIS-ICH).<\/li>\n<li><strong>The criterion for calculating payment terms changes:<\/strong> if the invoice contains the date of the operation, the term starts from that date; if not, from the date of issuance of the invoice.<\/li>\n<li>This new draft establishes the eventual creation of a free tool to generate electronic invoices, which will also be <a href=\"https:\/\/www.voxelgroup.net\/blog\/en\/the-role-of-verifactu-in-electronic-invoicing\/\" target=\"_blank\" rel=\"noopener\">Veri*factu<\/a>, if necessary.<\/li>\n<li>Alignment with European regulations <a href=\"https:\/\/www.voxelgroup.net\/blog\/en\/vida-the-revolution-of-digital-taxation-in-europe\/\" target=\"_blank\" rel=\"noopener\">ViDA (VAT in the Digital Age)<\/a>.<\/li>\n<\/ul>\n<h2>Operation of the Spanish electronic invoicing system<\/h2>\n<p>The issuance and reception of invoices and the notification of statuses will be carried out through the <strong>Spanish electronic invoicing system<\/strong>. This system is composed of the <strong>public electronic invoicing solution, private electronic invoicing exchange platforms (PIFEs), and the company.<\/strong><\/p>\n<p>The process will follow these steps:<\/p>\n<ul>\n<li>The issuing company will send B2B invoices through its PIFE.<\/li>\n<li>This PIFE must send a faithful copy of the invoice, in UBL format, to the public solution. The public solution will act as a repository and will also send the invoice to the recipient&#8217;s PIFE.<\/li>\n<li>The recipient must communicate the acceptance or rejection of the invoice and its payment within 4 calendar days from when each status occurs.<\/li>\n<\/ul>\n<h2>Next steps<\/h2>\n<p>From now on, and until April 7, <strong>a period of allegations<\/strong> is open for affected
