Crea y\u00a0Crece\u00a0Law:\u00a0mandatory B2B e-invoicing in Spain<\/span><\/b>\u00a0<\/span><\/h2>\n

The Crea y\u00a0Crece\u00a0Law introduces the obligation to use e-invoicing in transactions between companies\u00a0in Spain. Although it may be perceived as a purely technological regulation, its\u00a0objective\u00a0goes beyond that: it\u00a0seeks\u00a0to promote digitalization, while also combating\u00a0late payments\u00a0and increasing payment transparency<\/strong>.<\/span>\u00a0<\/span><\/p>\n

The recent approval of Royal Decree 238\/2026<\/a> and the publication of the draft Ministerial Order<\/strong> (currently in the public consultation phase) represent a significant step forward in the development of the regulation.<\/span>\u00a0<\/span><\/p>\n

In this regard, October 1, 2026, has been set as the effective date of the future Ministerial Order<\/a>. From this moment, the countdown towards the mandatory adoption of e-invoicing in the B2B environment will begin, with a gradual rollout depending on company size.<\/span>\u00a0<\/span><\/p>\n

However, the obligation is not limited to issuing and receiving invoices in\u00a0a structured\u00a0format. It also introduces the requirement to communicate the status of each received invoice (accepted, rejected, or paid)<\/strong>, which involves adapting systems to capture and report these statuses automatically and within the required\u00a0timeframe.<\/span>\u00a0<\/span><\/p>\n

The role of the Anti-Fraud Law and\u00a0VeriFactu<\/span><\/b>\u00a0<\/span><\/h2>\n

Within the legislative framework of e-invoicing in Spain, and alongside the broader digitalization process, there is another regulatory track focused on ensuring the reliability of invoicing systems: the Anti-Fraud Law<\/strong>.<\/span>\u00a0<\/span><\/p>\n

This is where\u00a0VeriFactu\u00a0<\/strong>comes into play. Unlike the Crea y\u00a0Crece\u00a0Law, it does not\u00a0primarily\u00a0require the issuance of e-invoices. Its purpose is different: to ensure that the invoicing systems used by companies\u00a0comply with\u00a0certain technical requirements that prevent manipulation or fraud<\/strong>.<\/span>\u00a0<\/span><\/p>\n

In other words, while some regulations define what must be done (issue\u00a0e-invoices), others define how the systems that enable it must behave.<\/span>\u00a0<\/span><\/p>\n

The implementation timeline for\u00a0VeriFactu\u00a0has been recently adjusted<\/a>.\u00a0Although it can be adopted voluntarily in advance, it is not yet mandatory.<\/span>\u00a0<\/span><\/p>\n
